Conditions governing use of the Recosport online store and online contracts concluded with RECOSPORT SRL.
This Recosport online store is operated by RECOSPORT SRL, a Romanian legal entity with registered office at Str. Avram Iancu 408H, Ap. 2, Florești, Cluj County, Romania, VAT/CUI RO28735800, Trade Register no. J2011001722123.
RECOSPORT SRL may be referred to below as “Recosport”, the “Seller” or the “Trader”.
Consumer means a natural person acting for purposes outside their trade, business, craft or profession. Professional/B2B customer means a legal entity, sole trader or another person buying in connection with a professional activity.
Consumer-specific provisions apply only where the buyer qualifies as a consumer under applicable law. B2B transactions are also governed by section 17, agreed commercial terms and applicable civil/commercial rules.
By using the website and/or placing an order, the customer confirms that these Terms were made available before the contract was concluded.
Recosport sells products for sport, recovery, physiotherapy, fitness, medical and recovery equipment, consumables, sports nutrition and other categories displayed on the website. Essential characteristics, availability, options and relevant warnings are shown on the product page and/or in the manufacturer documentation.
Product images are illustrative. Minor differences in colour, packaging or presentation may occur because of screens, production lots or manufacturer packaging updates, without changing the identity or essential characteristics of the ordered product.
Where required by EU product-safety rules, online offers may display the manufacturer, the EU responsible person where applicable, product identification and relevant safety information or warnings. Customers must follow the intended use, instructions, contraindications and warnings supplied with the product.
The price applicable to an order is the price displayed when the order is placed. For consumer sales, taxes are included unless clearly stated otherwise. Delivery charges and any additional applicable cost are shown before the customer submits the order.
Where a price reduction is announced to consumers, the prior/reference price is determined according to applicable price-indication rules, normally by reference to the lowest price applied during the 30 days preceding the reduction, subject to statutory exceptions.
If a price is personalised through automated decision-making in circumstances where the law requires disclosure, that fact will be communicated before the customer is bound by the contract.
An automatic acknowledgement confirms receipt by the system. The sales contract is concluded when Recosport accepts the order or dispatches the goods, as applicable under the information presented to the customer.
Before acceptance, an order may be declined for objective reasons such as lack of stock, invalid or unverifiable data, an obvious technical error concerning a product or price, inability to deliver to the address provided or reasonable fraud concerns. The customer will be informed and any payment received for a non-accepted order will be refunded without undue delay.
Available payment methods are those displayed in checkout at the time of ordering. Electronic payments may be processed by specialised payment-service providers under their applicable terms.
Invoices are issued on the basis of the information supplied by the customer and applicable tax rules. The customer is responsible for checking billing information before fiscal documents are issued.
Available carriers, delivery charges, any free-delivery thresholds and indicative delivery times are shown in checkout and on the Shipping and returns page. The information displayed in checkout for the specific order prevails over general information.
For consumers, unless another delivery time has been agreed, delivery will be made without undue delay and within the maximum period required by applicable law. Statutory remedies remain available in the event of delay.
Where a carrier is selected from the options offered by Recosport, the risk of loss or damage passes to the consumer when the consumer, or a third party nominated by the consumer other than the carrier, physically receives the goods.
We recommend checking the parcel on receipt and promptly reporting visible damage. This recommendation does not restrict statutory rights relating to damaged or non-conforming goods.
Consumers generally have the right to withdraw from a distance contract without giving a reason within 14 calendar days. For sales of goods, the period generally begins when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods, subject to the special rules for multiple deliveries.
The consumer may communicate withdrawal by the statutory model form or by any unequivocal statement sent before the withdrawal period expires.
For distance contracts concluded through an online interface, applicable Romanian law requires a permanently accessible online withdrawal function during the withdrawal period, including a clear confirmation step and confirmation on a durable medium with the content, date and time of submission.
Temporary channel: until Recosport’s dedicated withdrawal function is activated, the contact page and [email protected] can be used to send an unequivocal withdrawal notice. This temporary route does not replace the dedicated online function required by law.
The consumer must return the goods without undue delay and generally no later than 14 days after communicating withdrawal. Direct return costs are borne by the consumer unless Recosport has offered to bear them or provides a commercial free-return facility.
The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Original packaging is recommended for protection but is not, by itself, a general statutory condition for exercising withdrawal.
The withdrawal right does not apply in the cases provided by law. Depending on the product, relevant exceptions may include:
An exception applies only where its legal conditions are met for the specific product and its condition. Merely placing a product in a category such as supplements, hygiene, medical or recovery does not automatically remove the right of withdrawal.
Following a valid withdrawal, Recosport refunds payments received from the consumer, including the cost of the standard initial delivery where legally required, without undue delay and no later than 14 days after being informed of the withdrawal.
For sales of goods, where permitted by law, Recosport may withhold the refund until the goods are received back or until the consumer provides evidence of return shipment, whichever occurs first.
The refund is normally made using the same payment method as the original transaction, unless the consumer expressly agrees otherwise and incurs no fees as a result.
Consumer purchases benefit from the mandatory legal guarantee of conformity applicable to the contract. Under Romanian law, the seller is generally liable for lack of conformity which becomes apparent within two years from delivery, without prejudice to any longer or additional mandatory protection applicable to a consumer in another country.
Where goods are non-conforming, the consumer may be entitled to repair or replacement and, where the legal conditions are met, a proportionate price reduction or termination of the contract.
Under Romanian law, repair or replacement must be provided free of charge and within a reasonable period which may not exceed 15 calendar days from notification to the seller, as agreed in writing having regard to the nature and complexity of the goods and non-conformity. Mandatory local consumer rules remain unaffected.
From 27 September 2026, where the applicable rules and product category require it, consumers may be provided before purchase with information concerning repairability, availability and estimated cost of relevant spare parts, repair and maintenance instructions, repair restrictions and, for goods with digital elements, the minimum period for which the producer commits to provide software updates.
Where the producer provides, at no additional cost, a commercial guarantee of durability for the entire good lasting more than two years and the relevant information is made available to the trader, that information will be communicated in accordance with applicable law.
Recosport will not present a general legal obligation as a special commercial advantage and will not make durability, repairability or environmental claims without adequate factual and legal support.
If customer reviews are displayed and are presented as originating from people who purchased or used the product, Recosport applies reasonable and proportionate verification measures and provides information about the verification approach where required.
Fake or commissioned consumer reviews and misleading presentation of endorsements are not permitted. Where search results or product rankings are used in circumstances requiring disclosure of their main ranking parameters, the relevant information is made easily accessible.
For any complaint regarding an order, product or service, customers are encouraged first to contact Recosport at [email protected] or through the contact page.
Consumers may also use the competent alternative dispute resolution (ADR) body available under the law applicable to them. Where Romanian ADR is applicable, the national SAL mechanism administered within the Romanian consumer protection authority may be used.
The former EU Online Dispute Resolution (ODR) platform is no longer available following repeal of its governing regulation.
Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable law. Details about purposes, legal bases, recipients, retention periods and data-subject rights are provided in the Privacy Policy.
Cookies and similar technologies are governed by the consent mechanism and the dedicated cookie information available on the website.
Recosport aims to provide its e-commerce service in a perceivable, operable, understandable and robust manner in line with the accessibility requirements applicable to e-commerce services from 28 June 2025.
Where manufacturers or responsible economic operators provide information about accessibility features of products, Recosport aims to preserve and make that information available as required by applicable law.
For orders placed by companies, sole traders, clubs, associations, institutions or other professionals in connection with their professional activity, consumer-specific statutory rights do not apply unless a mandatory rule expressly provides otherwise.
Payment, delivery, commercial warranty, installation, commissioning, service, deadlines and liability may also be governed by quotations, contracts, accepted purchase orders, proforma invoices or other written commercial documents agreed by the parties. A specifically negotiated written term prevails for the relevant B2B transaction in case of conflict with these general terms.
Recosport takes reasonable steps to keep published information accurate and the website available. Material or technical errors identified will be corrected without undue delay.
Nothing in these Terms excludes or restricts mandatory consumer rights, liability for unsafe products, the legal guarantee of conformity or any liability that cannot lawfully be excluded or limited.
Users must not use the website for unlawful purposes, unauthorised access, distribution of malicious code, disruption of the service or infringement of third-party rights.
These Terms and contracts concluded through Recosport are governed by Romanian law. This choice of law does not deprive a consumer habitually resident in another country of the protection afforded by mandatory provisions of the law that would apply to that consumer under EU private-international-law rules.
Disputes should, where possible, be resolved amicably. If no amicable or ADR solution is reached, jurisdiction is determined by the applicable legal rules; this clause does not restrict mandatory consumer rights concerning territorial jurisdiction.
Recosport may update these Terms to reflect legal, technological or operational changes. The version applicable to an order is normally the version made available when the contract is concluded, except for mandatory legal changes that apply immediately.
The date of the latest update is shown at the top of this page.
